चेक बाउंस होने को एक दंडनीय अपराध माना जाता है. और ऐसा होने पर जुर्माना, और 2 साल की सजा दोनों का प्रावधान है. इसके खिलाफ धरा 138 के तहत केस दर्ज किया जाता है. जिस व्यक्ति का चेक बाउंस हुआ है उसे 2 साल की सजा के साथ ब्याज सहित रकम देनी होती है. यह जुर्माने की रकम कितनी बार चेक बैंक द्वारा लौटाया गया है इस पर भी निर्भर करती है.
चेक बाउंस के निम्न कारण होते है:-
यदि जारीकर्ता एक बुरी जांच लिखता है तो एक चेक बाउंस किया जाता है - तकनीकी कारणों से हस्ताक्षर या ओवरराइटिंग के मेल-मिलाप के कारण, या जब खाते में अपर्याप्त धनराशि होती है जिसके परिणामस्वरूप बैंक द्वारा संसाधित नहीं किया जाता है। तब चेक को अवैतनिक या अपमानित किया जाता है। बार-बार अपराधों में गंभीर असर पड़ सकता है।
